Regener-Eyes to DEF: “None of your business”

Our letter

On September 29, we sent an Open Letter to Regenerative Processing Plant LLC, the manufacturer of Regener-Eyes Ophthalmic Solutions.

In the letter, we ask three questions:

  1. What is in Regener-Eyes?

  2. Is it biologic?

  3. If so, what is its tissue or fluid of origin?

Their reply

On October 5, we received a Cease and Desist Demand letter from a representative for Regener-Eyes LLC.

Most of the letter is occupied with allegations, threats, insults, and demands. There is nothing surprising in the revelation that they would like us to press a delete button on biologiceyedrops.org in its entirety. But it is a mystery to me how they came to feel that my picking up a couple of leaflets and an imprinted stress ball from their booth at Vision Expo West last month - where these items were clearly intended for distribution to visitors - or my spending sixty seconds photographing some of their marketing materials are somehow “criminally punishable” acts, let alone Aidan’s innocent visit to ask a couple of questions, where they took one look at his badge and refused to even speak to him.

But I digress.

The C&D letter contains a brief response to our Open Letter to Regenerative Processing Plant LLC, wherein Regener-Eyes LLC’s position about sharing ingredient information with the public is made quite clear:

Your “Open Letter to Regenerative Processing Plant, LLC” is nothing more than a poor attempt to intrude into our client’s products, services, and trade secrets.

Can drug manufacturers legally avoid listing ingredients by calling them “trade secrets”?

No.

The Code of Federal Regulations requires the labels of over-the-counter medications and prescription medications to specify the active and inactive ingredients.
